It is a fantastic opportunity for employers to reward staff and recognise the previous 12 months hard work.<\/p>\n<p><strong>Simonne Watts<\/strong>, Head of <a href=\"https:\/\/rrpassociates.co.uk\/commercial\/employment\/\">Employment<\/a> at award winning and leading regional law firm RRP Associates says, \u201cStaff engagement and a time to socialise\u00a0 is usually the main driver for any work\u2019s Christmas party.\u00a0 Getting it right can have a positive impact on staff morale.\u00a0 If however it all goes wrong, the aftermath can involve costly legal consequences and a damaged business reputation.\u201d<\/p>\n<p>\u201cThe wise employer will have planned carefully and taken steps to <a href=\"https:\/\/rrpassociates.co.uk\/commercial\/employment\/day-to-day-employment-advice-and-support\/\">minimise these risks<\/a>. The ground rules will have been set with reminders being issued concerning expected standards of behaviour. The celebrations will be inclusive; absent employees will have been invited, adjustments made for staff with disabilities and those who do not celebrate Christmas, consume alcohol or certain foods due to their religion or belief. \u00a0On the big day, management safeguards will be in place behind the scenes to deal with bad behaviour particularly fuelled by excessive alcohol consumption.\u201d<\/p>\n<hr \/>\n<h3><span style=\"color: #3366ff;\"><strong>Even the best laid plans may go wrong, so what steps should be taken if they do?<\/strong><\/span><\/h3>\n<p><strong><br \/>\nTake all complaints seriously<\/strong><br \/>\nDo not dismiss any complaint as \u201cbanter\u201d or a \u201cjoke\u201d; all concerns should be dealt with seriously and sympathetically. \u00a0Employers should not forget that they can be held responsible for the actions of their employees at a work\u2019s social event.<\/p>\n<p><strong>Act immediately<\/strong><br \/>\nThe problem should not be left until the New Year.\u00a0 Most complaints can be dealt with quickly and easily. Delay can exacerbate the complaint and undermine your internal procedures.<\/p>\n<p><strong>Investigate<\/strong><br \/>\nA thorough investigation will minimise any legal risks. Where appropriate, talk to all parties involved, get statements from witnesses and gather evidence.<\/p>\n<p><strong>Be proactive in taking advice<\/strong><br \/>\nIf in doubt as to what to do or if the issues appear complex take advice about managing any process and the legal and financial considerations. Advice from the outset can put you on the right track and ensure any legal issues are addressed before it is too late.<\/p>\n<p><strong>Follow your policies and procedures<\/strong><br \/>\nThe complaint will determine which policies and procedures need to be considered. \u00a0A variety of policies may have been breached, such as Equal Opportunities, <a href=\"https:\/\/rrpassociates.co.uk\/general-news\/hollywood-workplace-harassment\/\">Bullying and Harassment<\/a>, Drugs and Alcohol, Social Media and the Disciplinary Code.<\/p>\n<p><strong>Take formal action<\/strong><br \/>\nAny concern must be dealt with under your <a href=\"https:\/\/rrpassociates.co.uk\/commercial\/employment\/day-to-day-employment-advice-and-support\/\">Grievance Procedure<\/a>. Any cases of misconduct should be addressed under your <a href=\"https:\/\/rrpassociates.co.uk\/commercial\/employment\/day-to-day-employment-advice-and-support\/\">Disciplinary Procedure<\/a>.
